Research spread out regarding imported flesh is incorrect

Question

I knew about this matter from long time ago, but didnt do any Tahkeek on it, no I have done so and I am raising this for benifit because muslims in non muslim lands make life difficult on themselves when they do not need to in this regard. See the Hijuj and Adillah presented by Mohammad Saleh Ibn Uthaymeen and Shiekh Abdul Azeez Ibn Baax (Rahmahullahalaikum Ajmaeen) on this matter.
Eating the Meat of Ahl Al-Kitaab (Jews & Christians)

Q. Is it permissible to eat poultry which is sold in the markets on the basis that it is meat of the People of the Book...or is it impermissible on the basis that it is a carcass slaughtered by unknown means i.e. was it done by cutting off the head or electrocution or some such means... and are the Ahl-Kitaab today truly to be considered in this ruling [as those of the past]?
A. Yes, eating the poultry is permissible because that which is slaughtered by the Ahl Al-Kitaab today is just as what was slaughtered by Ahl Al-Kitaab in the time of the Prophet (sallallaahu ’alayhi wa sallam). The Ahl Al-Kitaab are of the Kuffaar (disbelievers) whether they are in the time of the Prophet (saaws) or now.
Allah says in His Noble Book They have certainly disbelieved who say that Verily Allah is Isa Ibn Maryam and the Messiah said "O Children of Israel worship Allah my Lord and your Lord Verily whosoever commits shirk (associates partners with Allah in any way) Allah has made the Paradise forbidden to him and his end will be the Hellfire and there will be no help to the Dhaalimeen. They have certainly disbelieved who say that Allah is the third of three and there is no deity except the single Deity and if they do not desist from what they are saying We will inflict upon those disbelievers a painful punishment.
Allah also says in the same chapter: "Today I have made permissible for you that which is good and wholesome and the food of those who were sent the Scripture is permissible to you and your food is permissible to them."
As far as the methodology of the slaughtering we do not inquire about the method because if an action has occurred min ahlihi [at the hands of those suited to perform such an act] the conditions surrounding that act are not asked about.
We find in Saheeh Al-Bukhari: "It is related by Aisha (raa) that a group of people said to the Prophet (sallallaahu ’alayhi wa sallam) 'Some people came to us with some meat about which we didn't know whether the name of Allah was mentioned over or not' and he replied (saaws) Sammoo [Say the name of Allah] over it yourselves and then eat. She [Aisha - raa] said that these people had just recently been from the Kuffaar [i.e. just became Muslim and the question was not asked as to the method of slaughter].
This rule therefore applies to the Jews and the Christians about whom we don't know whether or not they have mentioned Allah's name or not because their slaughtered meat is halal [permissible] to us.
Q. Please clarify the fatwa - esteemed Sheikh - If a Muslim goes to the markets and eating places in a Christian land and purchases the lamb, beef, of chicken and does not ask about how it was slaughtered?
A. Yes, he does not ask about the method of slaughter.
Q. What if he is informed however that the meat has been stunned by electric shock, or has been choked or shot? What is the ruling for meat slaughtered like this? Is it considered a carcass? [Which is impermissible to eat]
A. It is not permissible if it is known with certainty because it would be considered a carcass.
Q. Can we understand from the hadith of Aisha (raa) which is related in the fatwa that the question which was posed by the people to the Messenger of Allah (saaws) was only in relation to whether Allah's name was mentioned over the animal being slaughtered and it was not about the actual method of slaughter?
A. Yes, they did ask about the mentioning of the name of Allah and not the actual method of slaughtering and it is evident in the hadith that it is not necessary to ask about either.
Q. Is it possible to say that if there are
stores in a city where the Muslim lives and those stores carry meat slaughtered according to the Islamic method - even of it is more expensive - that it is not then permissible to buy the meat of the Christians?
A. No it is not possible to say that because the slaughtered meat of the Christians and the Jews is halal. However whoever leaves it [doesn't eat it] out of a sense of piety [tawar'an], we see no fault upon him. [Tawar'a or wara' is when a person has such piety that they will avoid even that which is permissible to do what is even better from wanting to please Allah and also eliminating any possibility of doing something wrong].
Q. One of the readers asks about a relation from Ali Ibn Abi Talib (raa) in which he reportedly said: "Do not eat the meat slaughtered by Bani Taglab because they adhere to Christianity by drink alcohol." Can this be then used as a proof considering the Christians of today, the majority of who drink alcohol , that it is not permissible to eat their slaughtered meat?
A. I do not know the authenticity of this statement [from the Sahabah] and if it is authentic its meaning would be that they [Banu Taglab] were not actually on the religion of the Christians and therefore they would not fall under the ruling of permissibility of their slaughtered meat.
Q. If it is known that some of the slaughterhouses in this country slaughter sheep and cattle along with swine is it permissible to eat that meat especially when the same instruments are used to slaughter both at the same time?
A. In this case, if we know that the knives are used for both then the meat should be washed and it will be purified through washing.
Q. Is it possible - esteemed Sheikh - for you to address us with a word to the Muslim in the Western countries about the obligation of staying far away from disobedience [to Allah and His Prophet (sallallaahu ’alayhi wa sallam)] and haram things and doubtful matters because we are aware of some of them being lax in relation to some major sins such as not praying or illicit sex or drinking alcohol yet he is distressed or makes complicated the eating of meat which is not slaughtered according to Islamic method?
A. My advice to them is to have taqwa and fear Allah's punishment and to remember the Day of Meeting, a day which the excuses of those who wrong themselves will be of no avail. A day when the parent will not afford their offspring anything nor can the offspring do anything for the parent. A day when they will all be raised from their graves barefoot, and naked. We ask
Allah for all guidance and success.

Al-Imaam Ibn Baaz (rahimahullaah) discusses meat imported from the lands of the disbelievers
Question: In reference to the meats that are imported from outside (i.e. outside of the Kingdom of Saudi Arabia), and likewise the frozen chickens, which we do not know about their method of slaughter, since some of the scholars do not support purchasing them?
Answer: If the mentioned meats are imported from the lands of the People of the Book (i.e. Jews and Christians), it is lawful to eat them as long as you do not know something that proves its forbiddance. This is due to the statement of Allaah, far removed is He from imperfections:
"Today the good things have been made lawful for you, and the food (slaughtered meat) of those who have been given the Book (i.e. Jews and Christians) is lawful for you, and your food (slaughtered meat) is lawful for them." [Al-Maa'idah (5):5]
The fact that some of the slaughter houses in some of the lands of the People of the Book slaughter animals in a way that is not legislated, this does not neccessitate the forbiddance of the slaughtered meat that is imported from the lands of the People of the Book, until you know that this specific slaughtered meat (that you have) is from the slaughter house that slaughters in a way that is not legislated. Because the basic principle is that the meat is lawful and safe until something is known that contradicts that.

Al-Imaam Ibn Baaz (rahimahullaah) discusses meat of the People of the Book vs. the meat of other disbelievers
Question: Verily I am a Somalian student who studies in China and I face many difficulties concerning food in general and meats in specific. The problems are as follows:
1. Verily I heard before coming to China that the animals that the atheists slaughter, or it is more appropriate to say that they kill them, it is not permissible for the Muslim to eat them. We have a small restaurant at the university for the Muslims and in it are meats, but I am not certain that they have been slaughtered in the Islamic manner, and I have doubt about that, even though my friends do not have doubt like me. They eat from that meat. Are they correct or are they eating something Haraam (forbidden)?
2. In reference to the containers for cooking the food, there is no distinguishing between the containers of the Muslims and the cooking containers of people other than them (i.e. disbelievers). What is required of me to do concerning these matters?

Answer: It is not permissible to eat the animals slaughtered by the disbelievers except for the People of the Book, from the Jews and the Christians. It makes no difference whether those other people are Majians, or idol worshippers, or Communists or other than them from the various types of disbelievers. It is also not permissible to eat whatever is mixed with their slaughtered animals, such as the broth (or gravy) and other than it. This is because Allaah, far removed is He from any imperfections, has not permitted for us any of the slaughtered meats of the disbelievers, except the slaughtered meat of the People of the Book. This occurs in His statement, the Mighty and Majestic:
"Today the good things have been made permissible for you and the food (slaughtered meat) of those who have been given the Book is lawful for you and your food (slaughtered meat) is lawful for them."
This is the fifth verse from Surah Al-Maa'idah. And their food is their slaughtered animals, just as Ibn 'Abbaas and others besides him have said. In reference to the fruits and similar foods (i.e. vegetables, fruit, grains, fish, and so forth), then there is no harm in them because they are not included in the prohibited food. In reference to the food of the Muslims, then it is permissible for the Muslims and other than them, if they (those who slaughtered it) are truly Muslims, who do not worship anything other than Allaah, nor do they call upon anyone else besides Him along with Him, such as Prophets, righteous people, people who are deceased in the graves and other than them from that which is worshiped by the disbelievers.
In reference to the cooking containers, then it is obligatory upon the Muslims that they have cooking containers other than the cooking containers of the disbelievers, which they use to cook their food and intoxicants and so forth. If the Muslims cannot find containers (specifically for their use), then it is obligatory upon the Muslims' cook to wash the containers that the disbelievers use, and then put the food of the Muslims in them. This is due to what is confirmed in the two Saheehs (Al-Bukhaaree and Muslim) on the authority of Aboo Tha'labah Al-Khashanee (radhiyallaahu 'anhu) that he asked the Prophet (sallallaahu 'alayhi wa sallam) about eating from the containers of the polytheists. Thus, the Prophet (sallallaahu 'alayhi wa sallam) said to him, "Do not eat from them unless you cannot find anything else, then (if you can't find any other container) wash them (the disbelievers' containers) and eat from them."

ibn katheer’s explanation of al-maa’idah, verse 5:

After Allah mentioned the filthy things that He prohibited for His believing servants and the good things that He allowed for them, he said next, “made lawful for you today are the good things (at-tayyibaat).” Allah then mentioned the ruling concerning the slaughtered animals of the people of the Book, the jews and the christians, “the food of those who were given the Book is halaal for you,” meaning their slaughtered animals. this ruling, that the slaughtered animals of ahl ul-kitaab are halaal for muslims is agreed on by the scholars, because ahl ul-kitaab believe that slaughtering for other than Allah is haraam. they mention Allah’s Name upon slaughtering their animals, even though they have deviant beliefs about Allah that do not befit His Majesty.
Why are the US & UK christian countries?
1. majority ppl here are christian not Atheist
2. there are churches EVERYWHERE
3. the AMEER of the country is sworn in by putting his hand ON THE BIBLE.
4. any witness in the "shariah courts" of this country must SWEAR UPON THE BIBLE.
5. the money of the country from the $100 bill, to the 1 cent penny, all say "in GOD we trust" similarly on the £
6. christians are the only religious group here with their own tv stations (and multiple ones at that might i add)
7. Though the constitution is secular, the majority of this country is Christian as evident by the vote for the religiously minded head of states.
Also, we are not required to find out if it had been slaughtered or not, how it was slaughtered, whether they said bismillah when they slaughtered, b/c a hadeeth mentions that aa’ishah ra was given some meat by the jews and she took it to the Prophet saaws to ask him what she should do. he told her to say bismillah over the meat and eat it.


Answer

We went through your sending and worked upon it in the light of Quran, Sunnah, Aassar e Sahaba, principles of Hadith and Fiqh and the rulings given by all four schools of thought and found the research you send, not meeting the needs of above mentioned references. Before discussing Sharia`a ruling about the issue and commenting on sent Fatawa, it’s better to understand some basic principles.
Principle 1: Slaughtering isn’t a personal or social phenomena, it’s a distinct religious feature of Islam. Hence its authenticity needs some specific conditions to be fulfilled.
See these Ahadith, especially the colored segments:"Whoever performs our Salah (method of prayer), faces our Qiblah (direction of the Holy Ka'ba in Makkah), and eats the animals which we slaughter, is a Muslim who is deserving of the protection of Allah and his Messenger ".
There is another narration which emphasizes this point even more clearly. Rasulullah said, "I have been ordered to wage war with people until they say that there is no god but Allah. When they recite this, perform our Salah, face our Qiblah, and slaughter according to our way of slaughter, then their blood and wealth becomes sacred for us, except that blood and wealth in which a right has been established."
Hifiz Ibn Hajar says in the commentary of this Hadith:"We can deduce from this Hadith that we will deal with people according to the external actions which they present to us. This means that we will apply the laws of Islam to a person who outwardly does an action which is a distinguishing feature of Islam, unless he does something contrary."
In the above mentioned Hadith, Rasulullah has drawn a parallel between the Islamic method of slaughter, Salah and facing the qiblah. Thus, we can conclude that the Islamic way of Slaughter is a distinct symbol of Islam through which a Muslim can be distinguished from a non-Muslim.
Principle 2: The Conditions of proper Islamic Slaughter mentioned below, should be fulfilled.
According to the Sharia'a, the legal purification of the flesh of animals requires that the following fundamental conditions be met:
1. The animal should be slaughtered by a sharp object which is capable of making it bleed by severing blood vessels.
2. The slaughter is to be done by cutting the throat of the animal and the cut should not be so deep as to sever the spinal cord or head . The advised way is to cut the windpipe, the gullet, and the two jugular veins. "However if three of them are cut, it’s enough.
Rafi' Ibn Khadij narrates in a long hadith that his grandfather asked Rasiulullah peace be upon him: "Can we slaughter using a bamboo?'' Rasulullah replied, "Eat from those animals whose blood was drained and upon whom the name of Allah was recited.
However, if it becomes impossible to slaughter the animal in the specified manner, this second condition is cancelled; for example, the animal may have fallen headlong into a well so that its throat is inaccessible, or it may become wild and start kicking and running.In such cases, it is sufficient to wound the animal at any place to make it bleed. On the authority of Raf'i ibn Khadij, both al-Bukhari and Muslim report the former as narrating: We were on a journey with the Prophet (peace be on him) when one of the camels bolted away. As the people did not have a horse, a man shot an arrow which struck the camel and wounded it. The Prophet (peace be on him) said, 'Some of these animals are like wild beasts. If any of them behaves like this, treat it in this fashion.(Reported by al-Bukhari and Muslim.)
3. The name of Allah should be invoked or at least should not be left intentionally while slaughtering the animal. Allah Ta'ala says: Then eat of that over which the name of Allah has been mentioned, if you believe in His signs. (6:118)
And do not eat of that over which the name of Allah has not been mentioned, for truly that is impiety.... (6:121)
And the Messenger of Allah (peace be on him) said:If the blood is drained (from the animal) and the name of Allah has been mentioned over it, you may eat it. (Reported by al-Bukhari and others.)
This condition is further supported by other sound ahadith which state that Allah's name must be pronounced while hunting just before an arrow is shot or a hunting dog is sent for the chase.
Remember that every animal should be named individually, see this Hadith: A'diy Ibn Hitim narrates that he said, "0` Rasulullah, I send my dog and I find another dog with him. I do not know which of the two dogs caught the animal." Rasulullah said to him, "Don't eat from this animal because you recited the name of Allah on your animal and you did not recite the name of Allah on the other one."
You know better that in mechanical slaughter, several chickens are slaughtered at once without naming Allah on each of them.
4. Slaughterer should be either a Muslim or a Christian or a Jew.
Principle 3: The reason behind the authorization of an animal slaughtered by people of book is that they were also ordered to follow the same Islamic conditions in their religion.
An animal slaughtered by people of book is permissible ---as mentioned clearly in Tafaseer ----because the people of book follow the same conditions as ordered by Islam. See these references:
Great Mufassir Ibn Katheer said:
وهذا أمر مجمع عليه بين العلماء: أن ذبائحهم حلال للمسلمين؛ لأنهم يعتقدون تحريم الذبح لغير الله، ولا يذكرون على ذبائحهم إلا اسم الله، وإن اعتقدوا فيه تعالى ما هو منزه عن قولهم، تعالى وتقدس.
There is unanimity among religious scholars that the slaughter of people of book is Halal for Muslims, because they believe in unlawfulness of slaughter when a name other than Allah is mentioned. They don’t name except Allah on their slaughtered animals, though they have some mistaken beliefs about Almighty Allah. (He is far away from them)
لم يبح ذبائح من عداهم من أهل الشرك ومن شابههم، لأنهم لم يذكروا اسم الله على ذبائحهم، بل ولا يتوقفون فيما يأكلونه من اللحم على ذكاة، بل يأكلون الميتة، بخلاف أهل الكتابين ومن شاكلهم من السامرة والصابئة، ومن تَمَسّك بدين إبراهيم وشيث وغيرهما من الأنبياء، على أحد قولي العلماء.
Allah Ta`alaa doesn’t permit slaughter of idolatrous disbelievers and who resembles them, other than Christians and Jews because they don’t name Allah over them, moreover as compared to people of book, they don’t pay any importance to slaughter and eat even dead bodies.

Principle 4: An animal slaughtered in a Muslim or Christian country is no doubt halal. But if and only if
• it is not known surely(we call in Urdu Yaqeen) or
• at least not well known dominantly (we call in Urdu Ghalib Guman)
that some of the major condition are not fulfilled.
We are ordered to obey Islam according to human abilities. It’s quite obvious that everybody is not capable to visit every slaughtered animal in his city or country. So Sharia`a says either you yourself see the whole procedure or the area should be a Muslim or Christian country where conditions of slaughter are normally fulfilled.
The current scenario: Here I had better mention some references of Saudi officials (religious scholars) visited slaughter houses in various western countries and observed the practical situation, quoted by Mufti Taqi Usmani in his renowned book on the Slaughtered animals.
1. The method of slaughter in Holland:The animals are killed as quickly as possible after being stunned, and the blood is then drained out. The animals are stunned using a machine which makes them lose consciousness. (They are not allowed to cut the head or the neck, and civil regulations do not allow the use of a knife for slaughter). Therefore, the animals are killed using a helmet which contains a bolt filled with gunpowder which ignites and drives the hollow drill into the brain of the animal. This hollow drill returns back to its place before the head of the animal falls to the ground.
2. The method of slaughter in Denmark
Horses, oxen, and large calves are slaughtered through stunning. A piston made especially for stunning is used to shoot lead into the brain, and sometimes another type of pistol is used which releases a penetrating nail. Small calf and sheep are also slaughtered through stunning; either lead is used or the animal is struck with force on the front part of the forehead using a hammer. Regulations require that the chickens be slaughtered either by delivering a quick blow to the head with a hammer or by quickly separating the head from the body. When horses, oxen, and large calves are slaughtered according to the method described above, the blood is removed by placing a normal knife at the bottom of the neck where there is a large artery connecting to the chest. The blood of small calves and sheep is made to drain out by making an incision in the bottom part………The author further mentions, "All of this is solid official proof substantiating our claim that the animals slaughtered in these countries are killed by a violent blow and are impure corpses which are unlawful for a Muslim to consume, give to someone else, carry, or sell. I was already convinced of this fact because of what I had come to know about their method of slaughter during the five years which I was studying in Europe. I had discovered that they slaughter animals by hitting them once on the front of the head near the brain between the two temples using a tool made especially for this purpose. This blow makes the animal to fall to the ground unconscious. Out of fear of making a claim without proper knowledge, I have obtained written proof from the countries themselves. I am publishing this now so that people can come to know.
3. The method of slaughter in America
He also says, "I sent a letter to Doctor Abdul Hamid Mustafa Fargaly, who specializes in animal physiology at John Hopkins University in Baltimore, USA, asking him about the method of slaughter animals for consumption in America. I received a response from him on July 15, 1947 in which he said, "You asked me about the method of slaughter. The animal is struck with a pointed hammer in the head, causing it to die. Thereafter, the neck is cut. However, they do not slaughter according to the religious law of Muslims or the Jews, and they use this same method for all animals."

Sharia`a Ruling
The scholars of Fiqh hold the view that an animal slaughtered by the people of the book will only become lawful if they cut the required number of vessels using a sharp object. This is the correct view which is not only supported by Quran and Ahadith but also supported by the practice of Muslims throughout the ages, some of them have been discussed. The current scenario is: most of the slaughter houses in western countries are not exercising above mentioned conditions as they:
1. are using electric shocks and hammering or
2. do not name Allah on animals or
3. name Allah only at the starting of mechanism which is not sufficient or
4. slaughter so many poultry at a time which may cause some of them to remain alive and at least the condition of naming Allah is also not fulfilled.
Therefore we can easily conclude that eating flesh or poultry brought from Christian countries is not permissible until the whole procedure is surveyed and certified by any authentic Islamic certification institute or at least some authentic scholars who have personally visited the related slaughter houses, permit the usage of that poultry.
Commentary on the fatwa sent is though, not necessary but I would like to manifest some of the weak portions so that you understand in a better way the standard of sent research:
Portion 1:
Q. You have seen that great scholar clearly stated that slaughter by Ahl-kitab is permited just because they were adopting the same method ordered by Islam and named Allah on it .Today when christens have left all these fundamental conditions which are still mentioned in bible, how can we permit their slaughter.
Imagine if Muslims left this method, would it be permissible to eat such flesh? Are Christians more blessed than Muslims?
Portion 2:

This opinion is valid if:
1. Christians follow their slaughter method
2. Majority of them believe the basics of Christianity, though
it could be against Islamic Tridity or faith of Christ as a God`s son. Today both of the conditions are not fulfilled.
Portion 3:
Q. Can we understand from the hadith of Aisha which is related in the fatwa that the question which was posed by the people to the Messenger of Allah (saaws) was only in relation to whether Allah's name was mentioned over the animal being slaughtered and it was not about the actual method of slaughter?

A. Yes, they did ask about the mentioning of the name of Allah and not the actual method of slaughter and it is evident in the hadith that it is not necessary to ask about either.

Ibn Abbas and Abu Hurayrah narrate that Rasulullah told us to avoid the sharitah of Satan, i.e. an animal slaughtered, cut only to the extent of the skin, and left to die without cutting the vessel. Ibn Al-Athir says that a sharitah is a female camel or another type of animal that is slightly pierced in the throat. The vessels are not cut and neither is the blood drained out. This practice was common during the days of ignorance before Islam. The Arabs would cut a small part of the throat and would consider it to be a valid method of slaughter. The reason for attributing this type of slaughter to Satan is that Satan is the one who motivates them to do so.
A'diy Ibn Hatim narrates that he said, "0` Rasulullah, one of us shoots an animal (while hunting) and does not have a knife with him. Should he slaughter the animal with a flint or a piece of a stick?" Rasulullah answered, "Make the blood flow with the instrument of your choice and recite the name of Allah on it. Nasa'i has narrated this Hadith with thefollowing words, "I send my dog and it attacks an animal. I do not find a knife to slaughter the animal, therefore I slaughter it using a flint or a piece of stick." Rasulullah said, "Make the blood flow with the instrument of your choice and recite the name of Allah on it.

Q. Is it possible to say that if there are stores in a city where the Muslim lives and those stores carry meat slaughtered according to the Islamic method - even of it is more expensive - that it is not then permissible to buy the meat of the Christians?
A. No it is not possible to say that because the slaughtered meat of the Christians and the Jews is halal. However whoever leaves it [doesn't eat it] out of a sense of piety [tawar'an], we see no fault upon him. [Tawar'a or wara' is when a person has such piety that they will avoid even that which is permissible to do what is even better from wanting to please Allah and also eliminating any possibility of doing something wrong].

Q. One of the readers asks about a relation from Ali Ibn Abi Talib (raa) in which he reportedly said: "Do not eat the meat slaughtered by Bani Taglab because they adhere to Christianity by drink alcohol." Can this be then used as a proof considering the Christians of today, the majority of who drink alcohol , that it is not permissible to eat their slaughtered meat?
A. I do not know the authenticity of this statement [from the Sahabah] and if it is authentic its meaning would be that they [Banu Taglab] were not actually on the religion of the Christians and therefore they would not fall under the ruling of permissibility of their slaughtered meat.
Comments on highlighted part: This is a true statement and the justification provided by the scholars is powering our opinion, since most of the Christians of current age do not accept even God`s presence etc so they should be considered as Banutaglib and their slaughtered meat should be considered carcass.

Comments on highlighted part: This is a totally wrong opinion; the true principle is that the flesh of an animal is unlawful unless you definitely come to know that all the conditions mentioned above are completely fulfilled. Below mentioned Ahadith will clear you this point:

A'diy Ibn Hitim narrates that he said, "0` Rasulullah, I send my dog and I find another dog with him. I do not know which of the two dogs caught the animal." Rasulullah said to him, "Don't eat from this animal because you recited the name of Allah on your animal and you did not recite the name of Allah on the other animal.
